Terms of Sales

 

Article 1: Purpose of the General Terms and Conditions of Sale

These terms and conditions of sale specify the rights and obligations of the web Customer who buys a product on hb-atelier.com website within the framework of a distance selling system.

General information

The Customers using hb-atelier website acknowledge to be at least 18 years old and to be legally capable or authorized by their legal representatives to place an order on the website. The Clients acknowledge to purchase Products on hb-atelier.com for non-commercial purposes.

The order involves the full acceptance of these General Terms and Conditions of sales. Ticking the box « I accept the general terms and conditions of sales » will be considered as having the same value as a handwritten signature by the Customer. Consequently, it is more than advised to carefully read the General Terms and Conditions before placing any order.

In any circumstances, HB Atelier can be held liable for damage or injuries caused by improper or diverted uses of the Products.

In rare cases, allergies may occur to people presenting intolerance with gold or silver skin contact. It is advised to consider it before buying or offering a piece of jewellery. In any circumstances, HB Atelier can be held liable for these allergic reactions.

Products and packaging must be kept out of reach of infants and young children.

In any circumstances, HB Atelier can be held liable for any falsification or diverted uses of the Products, packaging, logo, or website.

Article 2: Products

 

2.1 Products orders and availability

The Products offered for sale are those listed in the Online Boutique.

The Products available immediately, considering the delivery time needed, are to be ordered by clicking on “Add to basket”.

Order
The available upon request Products are subjected to the delivery and making time which vary from one to another Product.

If not definitively out of stock, the available upon request Products can be ordered by addressing a message on the website Contact link to be informed on the availability and delivery time of the Product.

Once the making and delivery time is acknowledged and agreed by the Client, he will receive a confirmation order and will have to proceed to the payment as indicated to validate his/her order and for the making process to be started.

2.2 Products appearance

Each Product is handmade and therefore unique. Consequently, the items may have small variations in finish, in format and / or colours from one piece to another, all of which are inherent to this type of production and cannot be considered to be major defects.

We draw the Customer’s attention to the fact that the photographs illustrating our Products may differ slightly from reality due to the Customer’s screen settings causing variations in image and colour of the items shown digitally, for which HB Atelier cannot accept responsibility. The lighting when the photo shoot took place can also cause variations in colours.

HB Atelier takes great care when entering online Products information and descriptions but shall not be responsible of any unintended errors concerning those data.

Article 3: Prices, taxes and import duties

HB Atelier is a VAT-registered company in the Dutch chamber of commerce and apply the 21% VAT on his products. The Products prices sold on the website are in Euros (€) and all taxes included (VAT included) for the items sent within the EU, excluding postage charges.

The prices do not include the delivery costs, which are indicated with the order confirmation.

The current prices and their validity depend on the website updates. The prices can be modified at any time, without notice. However, no changes will apply on the prices indicated on the emailed invoice confirmation of an order placed before.

Orders shipped outside the EU are eligible for VAT free prices but may be liable for import duty.

Any order delivered outside the EU may be subjected to import taxes when the product arrives at the delivery address or after its delivery. These taxes are generally: the local VAT rate, Custom duties based on the invoice and administration fees.

It is the Client’s responsibility to contact the local customs office or post office for further information before placing an order.

Article 4: Orders

4.1 Selection of Products

Before placing an order, the Customer must carefully check the content of his/her basket to ensure that the item, the size, the metal colour, the delivery time and shipping options chosen are correct and suitable. The order confirmation shall have the value of entering in a contract.

Once the contract is concluded, the Customer will receive an email containing a summary of the order.

4.2 Unavailability of the Products of the Order

The offer for sale of the Products presented on the online shop is valid while stocks last.

In the event of unavailability of the Products ordered or if a computer error occurred in the stock management system, HB Atelier shall inform the Purchaser as soon as possible.

HB Atelier shall offer to supply the Buyer with a Product of equivalent quality and price.
If the Buyer accepts, in the context of exercising his/her right of withdrawal, the costs of returns shall then be taken in charge by HB Atelier.

In the event of refusal, HB Atelier shall reimburse the Customer within thirty (30) days of receipt of payment at the latest.

4.3 Quantity

HB Atelier does not intend to sell its jewelleries in large quantities. Therefore, HB Atelier reserves the right to refuse orders for more than 3 identical items.

Article 5: Payment methods

Payment can be made by PayPal, debit, or credit card (Debit card, Master Card®, Visa®, American Express®) and Ideal.

Order will be dispatched or can be collected at the Workshop after the full payment. Goods remain the property of HB Atelier until paid in full.

HB Atelier reserves the right to suspend or cancel any execution of an order and/or delivery, regardless of its nature and level of execution, in case of payment incident, or fraud or attempted fraud relating to the use of the online shop, including in connection with previous orders placed by the Customer.

Article 6: Delivery

6.1 Availability and shipping time:

The shipping time may vary depending on the destination, weekends, and holidays.

HB Atelier shall not be held liable for late delivery in the following cases:

  • Delay due to customs clearance of the exported goods
  • carrier failure
  • due to force majeure
  • Delay due to the Covid-19 restrictions

HB Atelier’s jewelleries are handmade produced in small quantity.

Some pieces are in stock in the workshop, ready to be shipped. They can be ordered by clicking on “Add to basket”. Only then, the order submitted via the online shop will, usually, be processed and shipped within 24 or 72 hours of receipt of full payment (excluding weekends, holidays, and vacation), unless we indicate otherwise.

If the item is not in stock on the online shop, you can contact HB Atelier with the Contact link to be notified more precisely about the making time.

The production time may vary, depending on the complexity of the requested piece and the sourcing time frame of its components provided by our suppliers. It may vary also during certain time of the year (Christmas holidays).

HB Atelier strives to reduce that period as much as possible and will notify the Customer when the piece is ready to be shipped.

  • Delivery Options

Carrier

Online purchases are subject to shipping charges whose cost depends on the delivery address location and on the insurance contracted, depending on the value of the purchase. The delivery cost will be indicated while placing the order.

Please make sure someone is available to sign for the parcel on delivery.

Within the Netherland, orders will be dispatched fully insured by Mikropakket.

EU and international orders will be dispatched insured by the courier service indicated when placing the order.

Pick-up at the Atelier

Please contact HB Atelier to collect your jewellery directly at the Workshop. We will schedule a convenient time slot for you to come.

6.3 Damaged packages

The Customer, or a person duly authorized by him/her to sign when receiving the packet, must check before signing the delivery note that the package and / or the contents have not been damaged due to the carrier.

In case of damage, the Customer must specify any apparent damage on the carrier’s delivery note.

In case of damage or non-compliance with the order, the Customer must report it by email at contact@hb-atelier.com within a maximum of 48 hours of receiving the order.

Article 7: Right of withdrawal and return

7.1 Right of withdrawal

In accordance with European legislation on consumer rights, the Customer has 14 days to cancel his order without specific reason and return the Product.

This fourteen 14 days period begins as of the day on which the Customer, or a third party that is not the carrier, designated by the Customer, receives the ordered item. The Customer must return the Product within 14 days.

In any circumstances the Customer shall return the Product on his/her own initiative without having contacted HB Atelier.

Before sending any products, please contact HB Atelier to be guided for the shipping.

The Customer must notify beforehand HB Atelier by email at contact@hb-atelier.com that He/she wants to apply his/her Right of Withdrawal, and to organise the return and refund of the jewellery. We will guide you with the return process.

The risks of damages or loss of the Product is transferred on the Customer once he/she, or a third party duly authorised has received the Product.

When the Customer applies his right of withdrawal, the costs of returning the Product, as well as the risks associated to the return, are exclusively at his expense. The Product must be returned in its display packaging (box, pouch, cloth bag) and in its protective packaging needed to the shipment (bubble wrap or other).

A label will be sent by email to the Customer with a link to schedule the parcel pick-up. The delivery cost will be deducted from the order refund amount.

No refund will be granted before we receive and control the jewellery piece.

HB Atelier will only accept to refund products if all the following conditions are met:

  • The Product must be returned in perfect resale condition (not worn, not damaged, washed, altered, or soiled). The jewellery must not have been personalized and/or engraved
  • In its original packaging, accompanied by any accessories (jewellery box, pouch, cloth bag, certificate)
  • With a copy of the invoice.

No refund may be made to any Customer who has not exercised his/her right of withdrawal under the terms of this Article.

7.2 Non conform to the order product Return

In the event that the return of the Product by the Customer is due to an error from HB Atelier, such as a wrong design piece delivered, a non-compliant product (subject to Article 2 hereof) or a manufacturing defect in the product, the Company undertakes to refund, in addition to the purchase price of the product, the shipping costs incurred by the Customer for the return of the product.

The Customer must report the error by email to contact@hb-atelier.com within a maximum of 48 hours of receiving the order by himself or a third party.

Upon receipt of the returned Product and after having ascertained the error, the refund will be made according to the will of the Client in the form of a credit valid for 12 months on the online shop or a refund credited directly to his bank account  depending on the mode of payment used when ordering

Note specifically for Ring and Bracelets: Sizes and Return

Rings

When the Customer orders a ring, it is his/her responsibility to ensure that he/she chooses the right size when indicating the size on the website or via email (Check Size guide for more information).

HB Atelier offers the possibility of readjusting the size of the ring if there has been an error on the part of the Customer when ordering.

The first re-sizing due to a Customer mistake is free, except from the returning and sending back transport cost. The cost of a second re-sizing and the return and going transport charges are paid entirely by the Customer.

Bracelets

When the Customer orders a bracelet, it is his/her responsibility to ensure that he/she chooses the right size.

Some bracelets sizes can be adjustable to a specific length if needed before ordering. Please contact HB Atelier to know if it is possible and if it requires additional costs.

In case the Client orders accidentally the wrong bracelet size, HB Atelier will take back the product and proceed to its refund less the shipping back costs only after reception of the product and only if the product complies with the return conditions exposed in Article 7.1 mentioned above.

The first re-sizing due to a Customer mistake, if the bracelet can be adjusted, is free, except from the returning and sending back transport cost. The cost of a second re-sizing and the return and going transport charges are paid entirely by the Customer.

Article 8: Warranty

In addition to the legal guarantees – EU law – by which HB Atelier is bound, we also offer a commercial guarantee that covers the repair of jewellery (replacement of clasps, broken chains, soldering).

The Customer can request the application of this guarantee by post or email (by returning the Product to us) or by coming directly to the workshop with the Product and proof of purchase. Before sending any products, please contact HB Atelier to be guided for the shipping.

This guarantee is free. We will refund the shipping costs.

The guarantee runs for one (1) year from the date of delivery of the product.

This guarantee does not apply to:

  • non-compliant or incorrect use
  • damage due to incorrect handling, abnormal use, intentional or accidental physical modification, use for business or commercial purposes
  • in the event of abnormal maintenance procedures or in the event of faults in maintenance and hygiene
  • in the event of natural wear
  • interventions carried out on the piece of jewellery by any person not approved by HB Atelier as well as damage due to such an intervention

 

Article 9: Intellectual Property

The entire Site and each of its constituent elements (such as trademarks, domain names, texts, trees, animation software, images, photographs, illustrations, packaging, diagrams, logos, sounds and music) are the exclusive property of Hélène Bouffard Atelier or third parties who have duly authorized Hélène Bouffard Atelier to use these elements.

No element of the Site, whether software, visual or audio, may be used, reproduced, distributed or published in whole or in part without the prior written consent of HB Atelier.

Design Rights and Copyrights remain the sole property of Hélène Bouffard Atelier.

Article 10: Changes and updates

The terms and conditions are changed regularly, notably to take into consideration any potential regulatory changes. The new terms and conditions shall apply as of the date of their publication on the Website.

Prices are correct at the time of publication. HB Atelier reserves the right to review her prices at any time.
